New York’s New No-Fault Divorce Law

While it is too soon to tell the full effects of New York’s newly enacted (October 2010) no-fault divorce law, one possible side effect may be a lessening in hostilities among the parties to a divorce. No longer must one party prove that the other party was unfaithful, abusive or cruel. By sidestepping the personal recriminations that come with charging one person was at fault, the parties may be better able to focus on the specific issues of disagreement.

The new statute regarding temporary spousal maintenance may likewise cool tempers when it comes to spousal support. Although the guidelines only apply to temporary maintenance, they may provide a useful starting point for consideration of ongoing support.
