Legal Custody and Physical Custody in New York
There are two forms of child custody that refer to the legal guardianship of children in a divorce.
- Physical custody refers to the residence of the child. In some cases, parents have joint physical custody, which means that the child lives with each parent half of the time. In other cases, one parent may have sole physical custody and the other may be granted visitation rights. Only when a court determines a parent to be unfit will no visitation rights be granted.
- Legal custody refers to decisions that are made about the child's lifestyle, including medical treatment, religion, education choices and others. Legal custody may be given to one or both parents.
If one parent is granted sole physical custody, visits between the non-custodial parent and child generally occur on a schedule that is worked out between the parties or is provided by the family court. It is typically in the best interests of the parents and the children to arrive at amicable agreements about custody and visitation, since these agreements usually fit the circumstances better than those determined by a judge.
