Divorce and Child Support Issues in New York City

In any divorce that involves children, child support issues must be resolved, either by the agreement of both parents or by order of the court. Understanding child support, including the formula that is used to calculate support payments in New York state, is important for parents. Child support is intended to benefit children after a divorce and it is crucial for parents to protect their children's rights in any divorce settlement.

The first step toward understanding child support and how it will impact your family is to talk with an experienced family law attorney. By waiting to get honest legal advice about your situation from a lawyer, you could be limiting your options and the ability to protect your rights. At my law firm of Albert Jacobus Myburgh, P.C., with more than two decades of legal experience in family law issues, including divorce, child custody and child support matters. I can help secure the financial support you deserve.

Child Support Guidelines

Family courts in New York state will take into account some circumstances that may impact a parent's ability to pay child support, but in most cases, a set formula is used to calculate child support payments. Typically, if the combined parental income is less than $80,000 per year, the non-custodial parent will pay 17% of his or her gross income for that year.

If the combined parental income exceeds $80,000 per year, the court will determine the amount of support that should be paid. In every case, the needs of the child are the most important factor. If, after a child support order has been granted, changes occur for either parent, a modification of the order may be necessary. I can help you with post-judgment modifications or enforcement.
