Child Support Guidelines
Family courts in New York state will take into account some circumstances that may impact a parent's ability to pay child support, but in most cases, a set formula is used to calculate child support payments. Typically, if the combined parental income is less than $80,000 per year, the non-custodial parent will pay 17% of his or her gross income for that year.
If the combined parental income exceeds $80,000 per year, the court will determine the amount of support that should be paid. In every case, the needs of the child are the most important factor.
