How Spousal Support Payments Are Determined

In calculating spousal support payments, there are generally three main factors that are considered by the court: the duration of the marriage, the standard of living from the marriage, and whether or not the person receiving spousal maintenance is capable of being self-supporting. There are three types of spousal support that my be granted by the court:

  • Permanent alimony, which remains in effect indefinitely or until there is a change in circumstances
  • Rehabilitative alimony, which is temporary and is designed to provide job skills or education
  • Restitutional alimony, which is also temporary and is given as repayment of support that was provided during a marriage while the other spouse gained education or vocational skills
