How New York’s New No-Fault Law Will Affect Spousal Maintenance
As of October 12, 2010, a no-fault divorce law was enacted in New York. The new law establishes a process for determining temporary maintenance during the period of the divorce that involves statutory guidelines similar to the guidelines used to determine child support. This is a significant change that will affect many couples seeking a divorce.
How Permanent or Time-Limited Spousal Support Payments Are Determined
In calculating spousal support payments, there are generally three main factors that are considered by the court: the duration of the marriage, the standard of living from the marriage, and whether or not the person receiving spousal maintenance is capable of being self-supporting. As your Manhattan alimony attorney, I know how to effectively present the necessary information and facts that will allow the court to appropriately set spousal maintenance payments.
There are three types of spousal support that may be granted by the court:
- Permanent maintenance (alimony), which remains in effect indefinitely or until there is a change in circumstances
- Durational or rehabilitative maintenance (alimony), which is time-limited and is designed to provide job skills or education to enter the job market
Spousal support may have a significant impact on your future and may even impact how you are able to provide for your children. It is critical to ensure that you are not hindered financially by spousal maintenance, or a lack thereof.
